PAIA Manual

Manual in terms of section 51 of the Promotion of Access to Information Act 2 of 2000 ("PAIA"), as amended.

1. Introduction and Purpose

The Promotion of Access to Information Act 2 of 2000 ("PAIA"), as amended by the Promotion of Access to Information Amendment Act 31 of 2014, gives effect to the constitutional right of access to information held by the State and by private bodies. Every private body is required to compile and make available a manual setting out the information it holds, the categories of records it maintains, and the process by which a request for access to those records may be made.

This manual is published by Trainiac (Pty) Ltd, a company registered in accordance with the laws of the Republic of South Africa, in compliance with section 51 of PAIA. It is intended to assist members of the public and other interested parties to understand the types of records held by Trainiac and the procedure for requesting access to such records.

2. Information Officer

In terms of PAIA, Trainiac has designated an Information Officer who is responsible for ensuring compliance with PAIA and for receiving and considering requests for access to records. The contact details of the Information Officer are as follows:

3. Categories of Records Held

Trainiac holds records across the following categories:

  • Corporate and statutory records (registration documents, MOI, board resolutions).
  • Financial records (annual financial statements, tax records, bank statements).
  • Human resources records (employment contracts, payroll records, performance records).
  • Client records (proposals, contracts, project deliverables, correspondence).
  • Supplier and vendor records (contracts, invoices, purchase orders).
  • Intellectual property records (learning content, methodologies, branded materials).
  • Compliance records (B-BBEE certificates, SETA records, licence documents).

4. How to Submit a Request

Any person who wishes to request access to a record held by Trainiac must do so in writing, using the prescribed Form C as published by the South African Human Rights Commission ("SAHRC"). The completed form must be submitted to the Information Officer at the contact details provided in section 2 above. Requests must include sufficient particulars to identify the requester and the records sought, and must be accompanied by the prescribed request fee where applicable.

Trainiac will respond to a request for access within 30 days of receipt, unless an extension is granted in terms of section 57 of PAIA. The prescribed request fee and access fee, as determined by the Minister of Justice and Constitutional Development, may be payable before access is granted.

5. Grounds for Refusal

Trainiac may refuse access to records on the grounds set out in Chapter 4 of PAIA, including, but not limited to, records the disclosure of which would involve the unreasonable disclosure of personal information, records subject to legal privilege, commercial information that could harm the competitive position of Trainiac or a third party, and records the disclosure of which is prohibited by law. Any refusal will be communicated to the requester in writing, together with the reasons for refusal and information about the requester's right to appeal or seek judicial review.

The SAHRC publishes a guide in terms of section 10 of PAIA that contains information to assist persons wishing to exercise their rights under PAIA.
